The general terms and conditions for Stream [GloBIVA Limited] are shown below. In the absence of any other contract between us, these terms will apply.

These terms and conditions are designed to be easy to read and to create a reliable, straightforward, and understandable business relationship between the Service Provider and the Service Seeker [client]. This document sets out the terms and conditions for providing professional freelance services between:
The “Streamer”, a Freelance Service Provider working via Stream [GloBIVA Limited] [Stream.ke].
One is sealed with this contract after either checking the accept terms and conditions, or registering on this website.
About this piece of work, project or ongoing agreement
The Service Provider agrees to provide freelance services to the client to the scope, quality, deadline and prices as outlined between them in writing via email, within stream portal, in a formal contract or as structured on our system.
Work scope, services, turnaround times, services, and pricing
Stream [GloBIVA Limited] is entitled to 20% of the total charged amount for a JOB done, and this is deducted from the Service Providers income.
When a Service Provider requests for withdrawal of funds, the amount is credited into the respective account within 24 – 48 Stream [GloBIVA Limited] working hours. Withdrawal is either by Kenyan Mobile money or PayPal.
Please check the Posted JOB [GIG] for details of the scope, turnaround time, services provided and the schedule of fees. If the scope or other aspects of the work change beyond what was originally agreed between the Service Provider and the Service Seeker [Client], services and rates may be renegotiated to take into account changes to the work.
Invoicing, deposits, and payments
All invoices will be raised and sent to the client from Stream [GloBIVA Limited].
Payment for work is requested before the commencement of work and put money in an escrow account..
Payment can be made by: debit card, credit card or PayPal.
Out of scope – What is not included in the price
Anything not listed under JOB [GIG] “Scope” is not included. Any reasonable requests for additional work will be considered. Any requests for changes must be made by the client in writing. Any change to the scope of the work after acceptance by the Service Provider may be subject to additional charges. Should such changes negate any part of the work already completed at the time of the changes, the client accepts responsibility for payment for any work completed to date.
The Service Provider agrees to:
Carry out work to the scope, quality, deadlines and prices listed in Appendix A and as agreed via other written communications.
Provide original, high-quality piece of work as requested by the Service Seeker [client].
Follow any special instructions provided by the Service Seeker [client] and agreed by the Service Provider.
Treat the Service Seeker with professionalism, courtesy, honesty, and integrity at all times.
Respond to any communications within a reasonable timescale, normally the same day.
The Service Seeker agrees to:
Provide supporting information, topics, guidance, article ideas, and other material as requested by the Service Provider to allow for creation of the work.
Provide or agree with the scope of work, deadlines, and other relevant information about the requested work.
Answer any questions asked by the Service Provider.
Provide prompt feedback on outlines, work, articles, and other content as requested by the Service Provider.
Promptly pay the fees as stated and invoiced by the Service Provider.
Point of contact
Cancellation of the work
We encourage our Service Seekers and Service Providers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site, users can contact Stream’s Customer Support department for assistance.
If the work is cancelled without the arbitration process, the Service Seeker [client] will be liable to pay any fees in full for the creation and production of the work to date. Any cancellations must be made through the Resolution Center, and as provided per our stated JOB[GIG] notice period.
The copyright to any documents created by the Service Provider remain with the Service Providers scope until any full payment for the work done is made in full. When the JOB is paid for, full copyright and any related rights pass to the Service Seeker [client]. At that point, the Service Seeker [client] takes full ownership of the writing and may make any changes and publish the document wherever they wish.
Any documents that the Service Seeker [client] provides to the Service Provider that are not intended to be included in the final work will be kept confidential. Any work created by the Service Provider that is not intended to be published or distributed publicly via a website, social media, or some other means will be kept confidential, and not shared with anyone outside Stream [GloBIVA Limited]. Any NDA agreement provided by the Service Seeker [client] and signed by Stream [GloBIVA Limited] supersedes this clause.
The Service Provider may link to publicly distributed or published work from his website, portfolio, social media accounts or other areas, unless requested not to by the Service Seeker [client]. Any such requests will be honored.
Final acceptance of the work
Upon completion of the work to the Service Seeker [client]s satisfaction, and full payment, this contract will be considered fulfilled. After completion of the work, the Service Provider bears no more responsibility to the work and the Service Seeker [client] is free to do with it as they wish.
Users may receive a warning to their account for violations of our Terms of Service or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user’s email address and will be displayed for such user on the Site. Warnings do not limit account activity, but can lead to your account losing Seller statuses or becoming permanently disabled based on the severity of the violation.
The Service Seeker [client] agrees to hold the Service Provider and Stream [GloBIVA Limited] harmless for any such damages that may arise from the Service Provider’s work. In no event shall the Service Provider be liable for any direct, indirect, punitive, incidental, special consequential damages whatsoever arising out of or connected with the use or misuse of their work product. The Service Provider assumes no responsibility for any special, incidental, indirect, or consequential damages of any kind, or any damages whatsoever (including without limitation, those resulting from her work product or from: (1) user or Service Seeker [client] reliance on the materials or documents produced (2) costs of replacement of job, work, writings, training, or documents (3) loss of use, data, or profits (4) delays or business interruptions, (5) and any theory of liability, arising out of or in connection with the use or performance of Service Provider’s work whether or not the Service Provider has been advised of the possibility of such damages.
